Hifzan Terms of Use

These Terms of Use ("Terms") are an agreement between you and Hifzan ("we," "us," or "our") about your use of the Hifzan mobile application and website (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. The Service

Hifzan helps you memorize the Quran. You can listen to recitations, practice and recite with feedback from our speech recognition, take tests, follow memorization plans and track your progress. Hifzan AI, an AI chat and voice coach, can help you plan and practice. We may add, change or remove features over time.

2. Your Account

  • You must be at least 13 years old to create an account;
  • Give accurate information when you sign up, and keep it up to date;
  • Keep your sign-in details safe. You are responsible for what happens under your account;
  • Tell us at [email protected] if you think someone else is using your account.

3. Hifzan Pro, Subscriptions and Free Trials

Some features, such as the voice coach and some practice and test modes, need a Hifzan Pro subscription.

  • Billing: subscriptions are sold and billed by Apple (App Store) or Google (Google Play), using the account you buy with. Prices are shown in the Application and in the store before you buy;
  • Auto-renewal: a subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the current period ends;
  • Free trials: if a free trial is offered, it turns into a paid subscription when it ends unless you cancel before the trial ends;
  • Managing and canceling: manage or cancel your subscription in your App Store or Google Play account settings. Canceling stops future renewals; you keep Hifzan Pro until the end of the period you paid for;
  • Refunds: refunds are handled by Apple or Google under their refund policies;
  • Account deletion: deleting your Hifzan account does not cancel your subscription. Cancel it in the store first to avoid future charges.

4. Free Features

You can use Hifzan without a subscription. Free accounts include a limited AI chat allowance, currently 30 messages in total (not per month), which we may change. The voice coach needs Hifzan Pro.

5. AI Features

Hifzan AI is powered by a third-party AI service provider. Before the Application first sends your data to this provider, it asks for your OK, and you can turn AI features off at any time in Settings, Privacy. What is shared, and when, is described in our Privacy Policy.

6. Acceptable Use

When you use the Service, do not:

  • Break any law, or use the Service to harm or harass others;
  • Try to get around a paywall, usage limit or other restriction;
  • Interfere with the Service, attack our servers, or try to access other users' data or accounts;
  • Copy, scrape, resell or reverse engineer the Service, except where the law allows it;
  • Use Hifzan AI to create unlawful, hateful or abusive content, or misuse it in ways that break our AI service provider's usage policies;
  • Upload content you do not have the right to share.

7. Feedback Is a Learning Aid, Not a Religious Ruling

Recitation feedback and Hifzan AI answers are generated automatically and can be wrong. They are tools to help you practice, not a religious ruling (fatwa) or a replacement for a qualified teacher. For tajweed, the correctness of your recitation, or any religious question, please consult a qualified teacher or scholar.

8. Intellectual Property

The Hifzan application, website, design and software belong to us and are protected by law. We give you a personal, non-transferable right to use the Service under these Terms. Quran text, translations, fonts and recitations used in the Service belong to their respective sources and reciters and are used under their terms. You keep any rights you have in content you create, such as your messages.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that the Service will be uninterrupted, error-free, or that feedback, scores or AI answers will be accurate.

10. Limitation of Liability

To the fullest extent the law allows, Hifzan will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim about the Service is limited to the amount you paid for Hifzan Pro in the twelve (12) months before the claim. Some places do not allow these limits, so they may not apply to you.

11. Termination

You can stop using the Service at any time, and you can delete your account in the Application (Settings, Profile, Delete Account; see our Account Deletion page). We may suspend or close an account that breaks these Terms or puts the Service or other users at risk. Sections 7 to 10 continue to apply after termination.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when the updated Terms are posted, with a new "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you in the Application or by other appropriate means. If you keep using the Service after a change, you accept the updated Terms.
